Terms of Service

These Terms govern your use of Variafy — the website at www.variafy.com, the hosted trial cabinet at app.variafy.com, and the self-hosted software license (together, the "Service"). By using the Service you agree to these Terms. If you do not agree, do not use the Service.
The Service is operated by Denys Volynskyi (sole proprietorship (jednoosobowa działalność gospodarcza) registered in Poland).
1. What Variafy does
Variafy takes an advertising creative you provide — your own winning ad, or a competitor ad you have the right to use as a reference — and generates on-brand variations for you to test. You review and approve before anything renders.
2. The free trial
The hosted trial lets you run a limited number of renders on our keys, at no cost and without a card. The trial is provided "as is" for evaluation. We may change the trial allowance or withdraw the trial at any time.
3. The license (paid)
The paid product is a one-time license to the self-hosted software, which you run on your own infrastructure and your own AI provider keys. The license is for your or your organisation's use to create advertising creatives. You may not resell, sublicense or redistribute the software as your own product. You pay your AI providers directly for usage; those costs are not included in the license fee.
4. Refunds
Because the license unlocks software you download and run, please use the free trial to evaluate fit before buying. If something isn't working, contact support@variafy.comand we'll make it right. Statutory consumer rights, where they apply, are unaffected.
5. Acceptable use
You agree not to use the Service to:
- infringe anyone's intellectual-property, brand or privacy rights;
- create deceptive, illegal, hateful or otherwise abusive advertising, or content that violates the policies of ad platforms (e.g. Meta) you push to;
- misappropriate a third party's trademarks or brand assets, or pass off their identity as your own;
- break the law, or attempt to disrupt or reverse-engineer the Service.
You are responsible for the inputs you provide and for ensuring you have the rights to use any source material, including competitor references, and the creatives you publish.
6. Your content and the output
You keep all rights to the images, text and brand assets you submit, and to the creatives Variafy generates for you. You grant us only the limited rights needed to operate the Service and produce your output (including sending your inputs to the AI providers that render the creatives). We do not use your content to train AI models.
7. Third-party services
The Service relies on third parties (e.g. AI providers, payments, ad platforms). Your use of those is also subject to their terms, and we are not responsible for their acts or omissions. See the Subprocessors page.
8. Disclaimer
The Service is provided "as is" and "as available", without warranties of any kind to the maximum extent permitted by law. AI-generated output may contain errors; you are responsible for reviewing it before use. We do not warrant any particular advertising result.
9. Limitation of liability
To the maximum extent permitted by law, Variafy will not be liable for indirect, incidental or consequential damages, or for lost profits or data. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim. Nothing in these Terms limits liability that cannot be limited by law.
10. Governing law
These Terms are governed by the laws of Poland, without regard to conflict-of-laws rules. Mandatory consumer-protection rights in your country of residence are unaffected.
11. Changes
We may update these Terms; the "Last updated" date will change and, for material changes, we'll give notice where appropriate. Continued use after a change means you accept the updated Terms.
